Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Call Bear, a service provided by Dostylo LLC ("Call Bear," "we," "us," or "our"), governing your use of the Call Bear app, website, and service (together, the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is offered in the United States. By using it, you represent that you meet these requirements.

2. The Service

Call Bear gives you a personal virtual phone agent that answers calls to a phone line on your behalf, follows the rules you set, takes messages, and — if you enable it — forwards calls to you. Your Call Bear is an AI, not a live human, and it identifies itself as an AI on calls. Call Bear is an assistance and accessibility tool; it is not intended to deceive anyone into believing they are speaking with a human.

3. Accounts and your number

To use the Service you create an account and verify a phone number. You may only connect a phone number you own or are authorized to use. You are responsible for the activity on your account and for keeping your sign-in secure. Tell us promptly at support@call-bear.com if you suspect unauthorized use.

4. Acceptable use

Call Bear is deeply personal and customizable — you can give your Call Bear almost any personality, within reason. But you agree not to use the Service to:

You are responsible for how you configure your Call Bear and for complying with the laws that apply to you and to your callers — including call-recording and consent laws in every relevant jurisdiction. We may review configurations for policy compliance, and we may suspend or terminate access for violations of this section.

5. Recording and consent

Transcription and audio recording are off by default. If you enable them for your line, you instruct and authorize Call Bear to provide the caller with an AI-disclosure and recording-consent notice at the start of the call and to proceed based on the caller's response. Call Bear applies an all-party-consent standard; if a caller declines, the call is handled without keeping a transcript or recording. You acknowledge that you are responsible for meeting any consent obligations that apply to your calls.

6. Subscriptions and billing

You purchase and manage your Call Bear subscription in the app. Payments are processed by our third-party payment processor, Stripe. Billing is measured in call sessions — a session is one handled call — not in minutes. Each plan includes a monthly allotment of sessions: Free includes 3, Plus ($14.99/month) includes 10, and Pro ($29.99/month) includes 25. If you need more sessions than your monthly allotment, you can buy prepaid session packs in advance — 5, 10, or 25 sessions for $7.99, $15.99, or $39.99, respectively. Session packs are a one-time purchase: we never automatically charge you for going over your allotment, and the sessions you buy are added to your balance to use whenever you need them. Subscriptions renew automatically each month until you cancel, and you authorize us (through Stripe) to charge your payment method for your plan and for any session packs you choose to buy. You can manage or cancel your subscription in the app; cancellation takes effect at the end of your current billing period. Payments are otherwise non-refundable, except where required by law and except that, if you delete your account mid-cycle we automatically refund the unused portion of that billing period (the app shows the exact amount before you confirm). We may change prices or plan features on a going-forward basis with reasonable notice.

7. Phone numbers

A phone number provisioned for your Call Bear is provided for use with the Service. It may not be portable, and we cannot guarantee that you can keep it. If you cancel or delete your account, or if the number is released or changed, the number may be released and may not be recoverable. Do not rely on a Call Bear number as your only or permanent contact number.

8. Availability and no emergency use

We work to keep the Service reliable, but it depends on networks, carriers, and third-party infrastructure, and it may be unavailable or interrupted. Because your Call Bear is an AI, it can occasionally misunderstand or make mistakes. The Service is not a telephone carrier and is not a substitute for 911 or emergency services; do not rely on it to place or receive emergency calls.

9. Intellectual property and your content

The Service, including the Call Bear apps, technology, and brand, is owned by us and our licensors and is protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service under these Terms. You retain ownership of the content you provide (such as your configuration and your messages), and you grant us the rights needed to operate the Service for you.

11. Disclaimers and limitation of liability

The Service is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that your Call Bear will handle every call as intended. To the fullest extent permitted by law, Call Bear and its providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data; and our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or others. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and governing law) will survive.

13. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in California have exclusive jurisdiction over any dispute that is not otherwise resolved, and you consent to venue there. Before filing a claim, you agree to first contact us at support@call-bear.com so we can try to resolve it informally.

14. Changes to these Terms, and how to reach us

We may update these Terms from time to time. When we make material changes we will update the date above and, where appropriate, notify you in the app or on our site; your continued use after changes take effect means you accept them. Questions? Email support@call-bear.com.
